Value Foundations of the Fiqh of Governance: Normative Principles for Political and Administrative Management in Islam

This article examines the value foundations of the fiqh of governance as an emerging field that connects Islamic jurisprudence with contemporary discussions on governance and public administration. The study proceeds from the premise that managerial and administrative decisions are inherently value-laden, and that their legitimacy depends on prior assumptions about human dignity, the distribution of authority, and the standards of rational justification. The article first identifies human dignity and institutional justice as core normative principles that guide the formation of administrative institutions, shape the relationship between state and society, and inform criteria for recruitment, promotion, and accountability within public organizations. It then addresses common value conflicts in governance practice—such as tensions between justice and efficiency or between order and freedom—and proposes a framework of normative prioritization in which justice, public trust, and the protection of collective resources take precedence while maintaining a necessary level of social order. Finally, the study explores the relationship between foundational values and the legitimacy of institutional arrangements. It distinguishes between normative legitimacy, which refers to consistency with justice-oriented values, and epistemic legitimacy, which concerns the quality of knowledge, reasoning, and evidence underlying policy decisions. The article concludes that a coherent fiqh of governance requires an integrated framework in which value-based rationality informs both rule-making and institutional design, while mechanisms such as consultation, transparency, and feedback translate foundational values into sustained practices of just and responsible governance.
