Investigating the legal, Jurisprudential and Regulatory barriers to Surrogacy in Iran and Proposed Solutions

Background and Objectives: About ۱۰ to ۱۵ percent of couples in the world are infertile and need assisted reproductive technologies. Surrogacy is one of the new phenomena of human society in childbearing, which is controversial despite complex legal, jurisprudential, and jurisprudential obstacles. This study aimed to examine these obstacles in Iran and the proposed solutions. Methods: This review study examined electronic databases PubMed, Web of Science, Google scholar, Magiran, SID, and articles using the keywords Surrogacy, Legal barriers, jurisprudential barriers and regulatory barriers between ۲۰۰۴ and ۲۰۲۵. Results: The present study by examining the legal, juridical, and jurisprudential dimensions and barriers related to genetic parents, surrogate mothers, and children born from surrogacy, shows that the existing gaps have caused numerous problems in the social, ethical, and judicial spheres, and ultimately a solution is presented. Conclusion: The findings of this study present the legal, regulatory, and jurisprudential barriers between the genetic parents, the surrogate mother, and the child resulting from surrogacy separately. The results of this study indicate the need to develop comprehensive and transparent laws in the field of surrogacy. These laws should include the regulation of standard contracts, supervision of infertility centers, determination of the legal rights and obligations of the parties, and resolution of disputes between jurisprudential and legal principles. Implementing these measures can reduce barriers, guarantee the rights of all parties, and increase public confidence in this treatment method
