چکیده مقاله:
This research aims to conduct a comparative study of the principles of fair trial in the process of investigating administrative violations of government employees. Fair trial, as one of the most important guarantees of human and religious rights, plays a vital role in protecting the rights of the accused and the legitimacy of disciplinary decisions. The research method is descriptive-analytical and comparative. And with an interdisciplinary approach, the principles mentioned in Iranian law (administrative laws and regulations) are compared with jurisprudential foundations (jurisprudential rules of justice, equality, and the right to defense). The research findings indicate that although Iranian laws are apparently committed to the general principles of fair trial, in the practical procedures of dealing with administrative violations, especially in the early stages, there are weaknesses in fully respecting the right to defense, the principle of transparency, and ensuring the impartiality of the investigating body, which often stem from the lack of adequate explanation of the jurisprudential foundations of the defendant's defense rights. Finally, suggestions are made to strengthen these principles in administrative disciplinary laws and regulations.
