Discrimination against migrant and refugee children is one of the fundamental challenges in the field of human rights and international law, which has extensive legal and social ramifications. This article analyzes the dimensions of discrimination against these children and the related challenges in supporting them, referencing credible domestic and international sources and adhering to legal principles. According to international documents such as the Convention on the Rights of the Child (۱۹۸۹), the ۱۹۵۱ Convention Relating to the Status of Refugees, the International Covenant on Civil and Political Rights (۱۹۶۶), and regional human rights documents, all children, regardless of their nationality status, should enjoy equal rights. However, an examination of the legal system in Iran and other countries shows that in many cases, access for migrant children to education, healthcare services, and social support is limited, and they are subjected to structural and procedural discrimination. This research, using a descriptive-analytical method and utilizing domestic and international legal sources, shows that one of the main factors contributing to discrimination against these children is the legal ambiguities and legal gaps in national systems. In Iran, the laws concerning foreign nationals and refugees, particularly in the areas of the right to education, the right to identity, and social support, face significant implementation challenges. To address these inequalities, it is suggested that legal reforms at the national level, effective accession to international treaties, and the establishment of independent monitoring bodies be prioritized. Additionally, cooperation among the government, international organizations, and non-governmental organizations can create opportunities to enhance the rights of migrant and refugee children.
