This study examines the civil liability of municipalities in relation to damages resulting from urban construction projects, emphasizing the role of geotechnical studies and considerations. With the rapid growth of urban development and the increased risks arising from soil instability, settlement, structural cracking, and damage to adjacent properties, clarifying the legal responsibilities of municipalities under private law is of critical importance. This research employs a descriptive-analytical methodology combined with a case study of construction projects implemented by Khomein Municipality. It investigates the legal foundations of municipal civil liability, focusing on fault, causation, and damages. The findings indicate that incomplete or inadequate geotechnical studies may constitute a form of technical negligence, providing grounds for municipal civil liability. Moreover, adherence to geotechnical standards during design and construction phases significantly reduces legal disputes and damage compensation claims. The study provides legal and technical recommendations aimed at enhancing project safety and minimizing the legal risks for municipalities.
