Environmental crimes have emerged in recent years as one of the most serious challenges confronting international criminal law. Uncontrolled industrial expansion, unsustainable exploitation of natural resources, and the environmental destruction caused by armed conflicts have collectively led to widespread and long-lasting degradation of ecosystems, threatening both human health and the survival of countless species. Despite possessing significant legal mandates, the International Criminal Court (ICC) has yet to establish a prominent and independent role in prosecuting environmental crimes. The Rome Statute, which governs the ICC's jurisdiction, lacks a distinct and autonomous definition for environmental offenses and remains predominantly focused on harm inflicted upon human beings. This anthropocentric legal orientation creates notable limitations in addressing environmental justice effectively. This article critically analyzes the ICC's current legal framework, assessing its capacities and constraints in prosecuting environmental crimes. It further reviews historical instances of environmental damage linked to armed conflicts, such as the oil fires during the Gulf War and industrial bombings in the former Yugoslavia, highlighting both the scale of environmental harm and the insufficiencies of existing judicial mechanisms. Additionally, the study explores evidentiary, legal, and political challenges inherent in holding perpetrators accountable for environmental destruction under international criminal law. Finally, the article proposes comprehensive recommendations aimed at overcoming these challenges, including the recognition of "ecocide" as an independent international crime, enhancement of scientific and expert capabilities within the ICC, and adoption of an ecocentric legal approach that acknowledges the intrinsic value of the environment beyond human interests. The conclusion emphasizes the necessity for fundamental legal and structural reforms to empower the ICC in effectively safeguarding the environment and achieving meaningful international criminal justice in this critical area.
