چکیده مقاله:

از آنجا که نه در حقوق بین الملل عرفی و نه در حقوق بین الملل معاهداتی به طور خاص به قانونی بودن جنگ افزارهای خودفرمان از منظر حقوق بین الملل بشردوستانه پرداخته نشده است، باید حقوق مربوط به جنگ افزارهای خودفرمان را بر اساس اصول بنیادین حقوق بین الملل بشردوستانه موجود بررسی کرد؛ مقصود این مقاله آن است که در ابتدا به توضیح جنگ افزارهای خودفرمان بپردازد و سپس قانونی بودن این گونه تسلیحات را از منظر حقوق بین الملل بشردوستانه تجزیه وتحلیل کند. هدف کلی ای که این مقاله به دنبال آن است، این موضوع است که آیا استقرار و به کارگیری جنگ افزارهای خودفرمان به دلیل محدودیت های تکنولوژیکی و حقوقی، قانونی است یا خیر. از سوی دیگر این مقاله همچنین در پی آن است که مسیر قانونی ساختن جنگ افزارهای خودفرمان را بررسی کند. در واقع در این مقاله نشان داده خواهد شد که اگرچه در حال حاضر جنگ افزارهای خودفرمان از حقوق بین الملل بشردوستانه تخطی می کنند، اما توان بالقوه آن را دارند که با اصول حقوق بین الملل بشردوستانه، در آینده تطابق بیشتری داشته باشند.
