Artificial Intelligence, Its Functions and Requirements in Iran's Criminal System with a Trail Approach

Background and purpose of the research: Perhaps this is how artificial intelligence can be defined, artificial intelligence is the study of how computers can be made to do things that humans currently do correctly or better. Artificial intelligence is the intelligence that a machine shows or the knowledge that is in the computer that is trying to create it. The right to use new technologies has always been considered one of the fundamental human rights in multiple generations, and one of its functions is to use this intelligence in the process of judicial proceedings. The purpose of this research is that artificial intelligence has the ability to be used as a prevention tool, a decision- making tool(assistant judge)and a decision- making tool(killed judge)in the judicial process, and if principles such as the rule of law, equality and non- discrimination, independence and impartiality and transparency are institutionalized in the algorithm fair, its use will lead to a fair trial, but in the application of artificial intelligence, it is possible to go so far that human rights are not violated. In order to achieve this goal, the engineers who created this tool should have a relative mastery of legal science so that all legal science so that all legal scientific subtleties are practically used in the design of the algorithms used in the products.Research Methodology: This study is a descriptive and analytical method and the collection of information has been done using books, articles and electronic resources and internet sites that in the upcoming research, the forms of using artificial intelligence in the process of fair criminal proceedings and the principles and requirements it has been checked. Ethical considerations: the goals of this research are that artificial intelligence and all kinds of smart assistants can help the judge to deal with cases faster and more accurately in legal references and issuing judgments by carefully studying the presented documents.Findings: A smart machine is a machine that can simulate human intelligence. Although a precise definition for artificial intelligence that is agreed upon by scientists has not yet been provided, most of the definitions provided in this field are based on one of these ۴ beliefs: ۱.systems that think logically. ۲. Systems that act logically. ۳. Systems that think like humans. ۴. Systems that act like humans.In recent years, according to new findings, regarding the application of prevention using artificial intelligence technology, it can be said: this has helped to improve and speed up police performance, increased accuracy in criminal investigations, and played an effective role in crime prevention and society will have high- risk behaviors. Also, it will play an effective role implementing preventive justice and creating security in the society and improving judicial decisions to grant cooperative institutions. Crime prediction is a method that is used to reduce the error rate judicial decision- making by using models and experimental studies and engineering and nowadays with artificial intelligence in the field of criminological issues. The process of discovering criminals and the operation of pursuit, surveillance and monitoring of the police and patrols has traditionally been a very time- consuming, tiring, costly and inefficient operation, and especially with growth and development of megacities and the development of apartment and cybercrimes of individuals, whose data collection and analysis is not traditionally possible, with artificial intelligence systems and software designed in this field, this stage can be done will be. Since there are many laws, artificial intelligence can definitely help the world of law and judgment, because the biggest challenge of our legal system today is the high volume of cases. Therefore, the use artificial intelligence as an assistant to the judge can compensate for the deficiencies and significant reduce the delay of the proceedings.Conclusion: The obtained results show that the great weakness that exists in the field of artificial intelligence in the country's legal system and must be compensated for is that the governing institutions have on their agenda the training of experts in the field of artificial intelligence.Among the suggestions that can be made is that we should increase the input of such fields and artificial intelligence should be taught in an interdisciplinary and special way, for example, a special field should be assigned especially in the field of law or any other specialization that is needed.When any knowledge is developed in a specialized manner in the country, the business and market of that knowledge will also develop, and knowledge- based companies will also increase in the same proportion.This is an issue that today more than any other time should be considered by the authorities so that the obstacles and problems can be removed one by one.
