چکیده مقاله:

کاربردهای نوین علوم اعصاب در تضعیف عملکردانسانها بر توسعه یسلاح های بالقوه جدید، به ویژه توسعه سلاح های«غیرمرگباری »نظیر عوامل شیمیایی ناتوان کننده، تاکید دارند این کاربردهاپرسش های علمی مهمی را در مورد چارچوبها و رویه های های مهمحقوقی در سطوح حقوق داخلی و بین الملل مطرح می سازند هدفاین مقاله بررسی رویه هاو چارچوبهای حقوقی حاکم بررسیدگی بهکاربردهای علوم اعصاب که باعث تضعیف عملکرد ا فراد بویژه درحوزه ی مواد شیمیایی ناتوان کننده (در مقابل سلاح های کشندهمی گردد می باشد بکارگیری این علوم به منظور اجرای قانونونظم عمومی و کاربردهای نظامی آن در عرصه های مختلف تحقیق،توسعه و امکانپذیری، تعیین خط مشی، و مسائل حقوقی ناشی از آناز جمله مسایلی ست که دراین پژوهش مورد مطالعه وواکاوی قرارمی گیرد اینکه ایا قوانین ومقررات حاکم بر ممنوعیت بکارگیریسلاح های کشنده ی شیمیایی وبیولوژیکی در عرصه های نظامیومیادین جنگ قابل تسری به سلاح های ناتوان کننده وغیر کشندهای که محصول فن آوری اعصاب بوده ودر برقراری نظم وامنیتکشورها ار آن استفاده می شودهست یا خیر ،موضوعی ست که درمطالعات موجود کمتر به آن پرداخته شده است.در این مطالعه ی توصیفی با بهره مندی از اخرین منابع موجودکتابخانه ای ومراجعه به معاهده ها و کنوانسیون های ی بین المللی ،قوانین مربوطه بررسی و چارچوبهای حقوقی حاکم بر کاربردهایعلوم اعصاب ازمنظرحقوق بین الملل، معاهدات بین المللی و قوانینحقوق بشر مطالعه وموردبهره برداری قرار گرفت نارسایی تعریف وتعیین وضعیت عوامل شیمیایی ناتوان کننده براساس مفادکنوانسیون (CWC)وهم پوشانی برخی از عامل های ناتوان کنندهمانند تنظیم کننده های زیستی هم در CWC و هم در BWC ازجمله نتایج این تحقیق است همگرایی بین علوم شیمی و بیولوژیکه به ترتیب درکنوانسیون های CWC و BWC مورد توجه قرار میگیرندایجاب می کنداین همپوشانی مورد خطاب هر دو کنوانسیونقرار گیرد ضرورت اقدامات مقامات اجرایی این کنوانسیون ها درجهت افزایش هماهنگی در پرداختن به روندهای همگرا در علوم وفنآوری در ارتباط با عامل های ناتوان کننده شیمیایی و توجه بهپیشرفت های علوم اعصاب، به ویژه در باره توسعه و دارو رسانیپپتیدها و دیگر ناقل های عصبی نیز که در CWC پیش بینی نگردیده و از نقاط ضعف کنوانسیون به شمار می ایداز دیگر نتایج اینتحقیق است باوجودظرفیت بالقوه موجود در سواستفاده از علوم و فناوری اعصاب، جایگاهی برای این علوم در فرآیند بررسی علوم و فن -آوری کنوانسیون BWC درنظر گرفته نشده و در حال حاضر پیمانی که مقررات مستقیمی برای توسعه این فن آوری ها در ارتباط باکاربردهای نظامی وضع کند، وجود ندارد.
