Mental illnesses are a group of illnesses that affect thinking and behavior, causing discomfort to the affected person and causing disability. From a psychiatric perspective, they are classified into two groups: psychosis and neurosis. In the first group, the person is unaware of their illness, does not consider themselves ill, and does not cooperate with treatment. In the second group, the patient is aware of their illness, considers themselves ill, and takes the initiative for treatment. The purpose of this study is to bring the perspective of criminal lawyers and criminal psychologists closer to examining mental illnesses from a criminological perspective, with an emphasis on dangerous states and insanity, so that by accurately determining the scope of mental illnesses and examining insanity at the time of committing a crime, it can prevent the punishment of such patients. To achieve this goal, a descriptive-analytical research method has been used, in such a way that by referring to written sources on mental illnesses and specialized texts in criminal law and psychology, the collected information has been collected and analyzed using a logical method and rational reasoning. The findings of the study indicate that among the selected samples of criminals, various types of mental illnesses are observed, including mental disorders with the highest frequency, psychoses (due to substance use or trauma) in the second place, followed by schizophrenia, bipolar disorder, depression, other mood disorders, mental retardation, schizoaffective disorder, and finally dementia in the next places. The result is that no human being is born a criminal by nature, and after being born with a pure nature, he is led to commit wrong and incorrect acts under the influence of inappropriate environmental and educational conditions, and the lack of mental health plays a significant role in committing crimes.
