چکیده مقاله:
Nowadays, the development of new technologies and consequently their legal challenges requires the adaptation of regulations to this field. One of these cases is artificial intelligence technology. Choosing a specific and coherent mechanism of civil liability for artificial intelligence is important from a social and economic point of view. National laws have different approaches to adapt to the challenges of artificial intelligence. Artificial intelligence is making astonishing advances in the exploitation of capabilities that were previously exclusively done by humans. Based on its knowledge and experience, the advanced artificial whisper can intend and perform various actions to achieve its goal. Nowadays, the necessity of adapting regulations to the challenges of modern technology is very felt. One of these cases is artificial intelligence technology. Systematizing the category of AI liability is important from a social and economic point of view. Therefore, it will be necessary to choose a specific and coherent civil liability regime for artificial intelligence. National laws are divergent and have different flexibility to adapt to the challenges of artificial intelligence. In general, in most of the regulations of European countries provide for liability based on fault as the principle. Regarding the basis of artificial intelligence liability, strict liability is also exceptionally proposed for four categories of special liability, along with an examination of the possibility of adaptation to artificial intelligence. According to the recent adoption of the European Parliament, which has been submitted to the European Commission in the form of a proposal, strict liability has been provided for the operators of high-risk AI systems, and in case of multiplicity, joint and joint liability, and for other AI systems, fault-based liability has been identified as the basis. With the expansion of the ۵G Internet and the use of machine learning more and more, as one of the subfields of artificial intelligence, the legal system will face various legal questions.
