چکیده مقاله:
The way advocacy is conducted in courtrooms differs greatly depending on the legal systems, traditions, and procedural norms of different jurisdictions. Nevertheless, some core principles of successful legal representation seem to go beyond country borders and are essential for successful advocacy in courtrooms worldwide. This article investigates the possibility of creating a universal set of advocacy principles through comparing advocacy in common law and civil law systems. By analyzing global legal norms, legal precedents, and discussions with legal experts, the study highlights key components of effective courtroom advocacy. These aspects, such as persuasion, ethical responsibilities, procedural tactics, and cross-cultural flexibility, are examined in relation to modern philosophical concepts of representation. By delving into the writings of philosophers like Robert Brandom and Jacques Derrida, the research offers a more profound insight into the function of representation in legal advocacy. The universal framework that has been suggested aims to help enhance legal representation on a global scale by providing valuable insights for legal professionals, teachers, and policy makers.
