چکیده مقاله:

Iran's civil liability law does not necessarily consider the fault of the defendant as a condition for fulfilling responsibility. In order to realize civil liability, in addition to the necessity of incurring a loss and committing a harmful act or omission, the causal relationship between the act and the omission of the harmful act and the damage must also be established. The research was conducted using the Descriptive method and the random sampling plan of ۳۸ civil liability lawsuits and the judgments issued in the primary and appeal stages of the Supreme Court and the Administrative Court of Justice. The results have shown that if the relationship of causation is established, the court will issue a verdict in favor of the plaintiff, and if the relationship of causation is not established, it will issue a verdict against the plaintiff. In general, it is concluded that the existence of causation relationship is necessary to fulfill the elements of civil responsibility and to assign damages to the defendant
