چکیده مقاله:

The developing of human relations and advancement of civilization has caused establishment of some institutions to organize the given relationships, which are called as legal entities that have been identified as the prevalent credit reality today. Typically, these entities possess their own specific goal and interests thus they may threaten the peace and security of society to achieve their objective similar to natural persons. Therefore, defending from community and social justice may require that these entities to be punished in the case of threatening the peace and security. Despite of several problems given regarding criminal liability of legal entities, this responsibility status has been accepted for these entities in the regulations of typically advanced countries. But, the laws in our country have not explicitly determined all dimensions of the liabilities of the legal entities and their responsibility but they have been accepted within certain framework in most of cases. Our topic that is discussed in this study is concerned with legal entity of hospital in such a way that can be responsive for performance of board of directors, managing director, all medical and non- medical personnel and the used tools in hospital since as an institution the hospital is concerned with human’s physical and mental aspects so it has naturally special position and plays vital role in healthcare, spiritual security, and social order. We have proved in this study that the legal entity of hospital has responsibility in terms of various dimensions where such a liability includes several dimensions such as administrative responsibility, medical responsibility, paramedical responsibility, responsibility for using non-standard or worn tools, and responsibility against non- providing advanced tools for treatment.
