چکیده مقاله:

The promotion and protection of human rights are at the core of legal systems worldwide. Human Rights serve as a basic standart of democracy and rule of law. Recently human rightsgenerations have been expanding ,and it is understable because of the theory of development and social changes. Right to a corruption-free society is at the core of human rights generations because enjoyment of numerous freedoms and human rights is strongly linked toa corruption-free society. Very important principles as Equality principle,non discrimination principle and moreover could not be exercised in a corrupted society. Ensuring right to acorruption free society and punishing corruption when it occurs it is a scope of internationallegal instruments. Numerous legal instruments,legally binding instruments combat,preventand fight corruption as a transnational phenomenon that makes international cooperation essential. Albania has ratified most of international instruments,even that it is a crucial case of corruption in Europe because of high levels of it according to statistical datas.It is thecorruption in Albania caused by implementation of legal framework? Right to a corruptionfreesociety is part of constitutional human rights,it is in administrative law as well as freeservice principle and it enjoys penal protection since penal law sanctions it as a criminaloffence.In this research paper it will be dealed with the international legal instruments compared to the three objects of study of Albanian law (constitutional,administrative and penal law) analyzing their legal framework coming in the conclusion why the albanian legislation ensuring right to a corruption-free society is not effective.
