The rapid advancement of nanotechnology and its potential applications in the development of sophisticated weaponry have raised significant legal and ethical questions within the framework of international disarmament law. This paper explores the legal feasibility of employing nanotechnology in weapons development, analyzing its compatibility with existing international treaties and disarmament regimes. A thorough examination of relevant legal instruments reveals that while some disarmament treaties directly and clearly apply to the use of nanotechnology in weapon production, others require interpretative extension to adequately cover such emerging technologies. This interpretative process must be carried out with precision, ensuring that prohibitions are articulated clearly enough to prevent states from exploiting legal ambiguity to circumvent their disarmament obligations. One of the most persistent challenges in the implementation of disarmament treaties is the invocation of national interest and military security by states, which often undermines the humanitarian goals of these agreements. As a result, many disarmament efforts have fallen short of achieving complete disarmament and have instead been limited to controlling and restricting specific categories of weapons. The article argues that the spirit and intent of disarmament treaties particularly those reviewed in this study are fundamentally aligned with the reduction of human suffering and the redirection of scientific advancement toward peaceful purposes. Accordingly, states are urged to act in accordance with the shared objectives embedded in these treaties and to engage in cooperative efforts to ensure compliance and effective enforcement. At the same time, this article emphasizes that the dynamic nature of science and technology necessitates the periodic review and revision of existing treaties to keep pace with technological evolution, thereby reinforcing their relevance and efficacy in promoting international peace and security.
