Cyberspace Jurisprudence: Emphasizing the Necessity of Its Application in the Contemporary World

Digital technology and the cyberspace industry have introduced a new framework and structure for human life. In the modern context, life in cyberspace is effectively the same as life in the "real world" as traditionally understood. Managing its use in a healthy, optimal, and prosperity-fostering manner requires individuals to embrace a sense of responsibility—guided by Islamic jurisprudence and its binding, duty-oriented mandates—and to ensure the integrity of its application by precisely and rationally identifying the relevant issues and rulings, drawing upon insights from other related disciplines. This article seeks to elucidate the jurisprudence of cyberspace by evaluating its practical application within the context of daily life; the study employs a descriptive-analytical approach based on library research. The findings indicate that, regarding the role of cyberspace in shaping lifestyle patterns, Islamic jurisprudence adopts an instrumentalist perspective—acknowledging the medium's dual nature as both a source of guidance and a potential cause of misguidance. Consequently, it regards the use of cyberspace as subject to specific jurisprudential and legal requirements, entailing the acceptance of corresponding religious and legal responsibilities.
