Elaboration and Development of Civilization-Building Jurisprudence and a Transnational Perspective on Islamic Jurisprudence

Civilization-building jurisprudence represents a new horizon in jurisprudential studies, offering profound and rational potential for addressing civilizational issues within the framework of Sharia. Moving beyond an individual-centric focus and isolated rulings, this approach shifts toward a macro-level, systematic, and society-building understanding—one that examines the role of religion in guiding social progress, organizing human relations, and establishing a harmonious, purposeful system. In essence, civilization-building jurisprudence embodies a "transnational perspective on Islamic jurisprudence"; given its universal, unifying, and cross-border nature, Islamic Sharia possesses the capacity to address the complex challenges facing contemporary humanity on a scale that transcends geographical boundaries. The present study employs a descriptive-analytical method to examine civilization-building jurisprudence and its transnational dimensions. In this context, the theological and jurisprudential foundations of a civilization-building jurisprudence have been elucidated, and the civilizational capacities of Islam have been analyzed in light of Quranic verses and traditions. Furthermore, a novel model for structuring individual and social life has been proposed—one that emphasizes modernizing methods of legal inference, addressing the emerging needs of societies, and enhancing the civilizational functions of jurisprudence. Ultimately, the connection between the civilization-building potential of jurisprudence and a transnational perspective is demonstrated; this approach paves the way for the revival of Islamic civilization and offers a wise, coherent, and universal response to the challenges of the modern era.
