چکیده مقاله:

The determination of the governing law for multimodal transport contracts holds great significance. International conventions and legal frameworks have each presented distinct perspectives on this matter. The governing law applicable to international contracts of carriage of goods can be determined by taking into account the various modes of transport involved. There are also specific international and Islamic legal regulations concerning this type of transportation. This article examines and analyzes the governing law applicable to international multimodal transport contracts, considering different legal theories and existing approaches. The aim is to clarify the legal and regulatory position of multimodal transport within the scope of international trade. This issue is also important in terms of defining the responsibilities and obligations of carriers. On the other hand, it should be noted that a multimodal transport contract is composed of combined transport modes—maritime, air, land, and rail. In brief, whenever transportation is carried out in several stages using different means, it is categorized as multimodal transport. The first part of the article explains the definition and concept of multimodal transport and its various dimensions. The second part discusses the governing laws applicable to such contracts and their relationship with international conventions. Finally, the responsibilities of carriers, cargo insurance, and the role of related transport documents are analyzed.
