Intellectual Property Rights in Data Transfer: Challenges and Solutions in Management Information Systems

Management Information Systems (MIS)play a critical role in organizational advancement by improving decision-making and operational efficiency.However, the transfer of data within these systems raises significant intellectual property rights (IPR) concerns that require legal protection for data producers and owners. This study investigates the current state of IPR in data transfer, its governance implications, legal frameworks, and secure transfer strategies.Using a qualitative approach with thematic analysis, the research conducted semi-structured interviews with nine IPR and MIS experts through snowball sampling until theoretical saturation was achieved. Validation methods included participant review and coding agreement coefficients.Findings reveal that while Iranian laws like the Copyright Law and Trade Secrets Protection Law represent initial steps in IPR protection, significant challenges remain. These include unclear data ownership boundaries, sharing limitations, lack of professional awareness, and inadequate technical infrastructure. IPR impacts organizational governance through effects on data ownership, innovation, competitive advantage, and decision-making processes, with additional complexities introduced by global privacy regulations like GDPR and CCPA.The study proposes an IPR framework incorporating policies, technical/organizational controls, monitoring mechanisms, and emerging technologies such as blockchain and homomorphic encryption. Key strategies for secure data transfer include: establishing formal sharing agreements, implementing data anonymization techniques, developing access control systems, conducting awareness programs, and enhancing security measures.The research concludes that effective IPR protection in MIS requires a multidimensional approach addressing legal, technical, and educational aspects. Comprehensive legal reforms, infrastructure improvements, and user education are essential for organizations to safely leverage data while protecting IPR, ultimately leading to enhanced governance and innovation capacity.
