چکیده مقاله:

Punishment constitutes a fundamental institution within criminal law, serving the primary goals of upholding justice, deterring criminal conduct, and rehabilitating offenders. This research employs a descriptive-analytical methodology and library resources to conduct a comparative analysis of the objectives of punishment in Iranian law and the International Criminal Court (ICC). While both systems are guided by overarching principles of deterrence and rehabilitation, their foundational philosophies differ significantly. The findings indicate that in Iranian law, punishment is deeply rooted in religious doctrine and strongly emphasizes the preservation of social order and security. In contrast, the ICC's penal philosophy is primarily oriented toward the realization of international criminal justice, the prevention of atrocity crimes (genocide, war crimes, crimes against humanity, and aggression), and the consolidation of lasting peace. Ultimately, the study concludes that within both frameworks, punishment transcends mere retribution; it functions as an essential mechanism for achieving justice, safeguarding human dignity, and preventing recidivism.
