چکیده مقاله:

Unfortunately, sometimes unfortunate news is heard about punishment at the school level. The death of a student due to a concussion as a result of corporal punishment by a teacher and the viewing of videos of students being corporal punished in the classroom are important and unforgettable stories. Punishment means informing a person of a mistake and not repeating it, but the Executive Regulations of Schools and the Law on Handling Administrative Violations stipulate its prohibition, and in cases related to the occurrence of criminal offenses by offenders, it is also subject to criminal prosecution under the Islamic Penal Code. In addition to administrative violations, cases of assault, indecency, and intentional crimes can also be handled through the first-instance and appeals board of the Ministry of Education. Therefore, in this article, with an analytical method, in order to understand and make teachers and educational factors aware of the recurrence of similar incidents and the consequences of the issue and reminding managers of their responsibility in this regard, the philosophy of the issue of punishment, types, limits, necessity, and legal provisions related to punishment were explained and several solutions and suggestions were presented.
