Child Custody from the Perspective of Sharia and Law

Islam as the most complete and heavenly religion has provided many guidance and indication on children rights. Islam views infancy as a pleasant world of joys beauties, dreams and affection. The verses of the holy Quran illustrate Allah’s love and compassion for children. As Allah swore to surah (Al/balad / verse ۳) (I swear to the father and his son) Allah has also said in surah Kahef /verse ۴۶ (property and children are the ornament of life in the world). The mother’s existence has provided the family center for children to grow up healthy and well. And save the children from the risk of drowning in unfortunate Whirlpools and unhealthy behavior. That is the point which Islamic laws have always emphasized they need to preserve the family center relationship as prophet (peace be upon to him) said: the worst thing with almighty god is divorce. The sacred religion of Islam has paid much attention to children. As for Hussin bin Ali whenever he was a child he sat behind the prophet during the prayer and he did not prostrate himself and continue to pray with all its values and significance.
