چکیده مقاله:

White marriage is an emerging phenomenon in Iranian society that, due to social, cultural, and economic developments, is becoming increasingly prevalent. This type of relationship, meaning the cohabitation of couples without official marriage registration, faces legal and social challenges in many countries worldwide. In Iran, due to the legal structure based on Sharia and the traditional family system, white marriage faces serious legal gaps, and the legislator has not yet had an official and codified approach to this phenomenon. This article, with an analytical-descriptive approach, examines the existing legal gaps in Iran's legal system regarding white marriage, the legal status of children resulting from these relationships, as well as its social consequences. The findings indicate that the legislator's silence, in addition to creating legal insecurity for the parties, has widespread negative consequences for mental health, social security, and the family system. Finally, solutions for formulating appropriate regulations and increasing social awareness are suggested.
