Nowadays, the digital economy encompasses the evolution of various economic activities, including developing, adapting, marketing, and consuming products and services, facilitated by Information Technology as a production component. The digital era has experienced an increase in the development of new business models and methods and the implementation of inventions to products and services. Inventors, scientists, and artists are extensively utilizing digital platforms to raise innovations, which has improved digital progress. these investments must be preserved by Intellectual Property (IP), as this is what will be regarded as a reasonable return for the time and resources used to create the inventions. Intellectual Property is known as the formation of mind, which causes the creation of Intellectual Property Rights (IPRs) like trademarks, copyrights, patents, and trade secrets. The remarkable development of e-commerce has presented novel difficulties to intellectual property (IP) protection. With the expansion of digital marketplaces, copyright and trademark infringements have grown more common. On the other hand, the extensive use of e-commerce in the digital era has caused a new difficulty in the enforcement of trademark rights, the multinational aspect of cyberspace has made it difficult to manage trademarks on a global scale. This narrative aims to analyze the complex relationship between IP and the digital marketplace, mention available gaps and presents possible ways to reinforce IP protection.
