چکیده مقاله:

The growing development of international trade has dramatically expanded the circulation of trade documents on the international stage, which creates a conflict. Ease of circulation of business documents is one of the basic features of such documents that fuels the emergence of many conflicts and in order for international trade to not be interrupted and problematic, it inevitably requires the search for solutions. And to remove barriers and problems the UN Commission has established regulations and rules for existing trade rights. One of these commercial documents is a check. As one of the most important business documents, one of the best, most effective and most accessible tools for facilitating business relations, the check has reached such a degree of importance in a short time that its role and place in the international arena can hardly be denied. The aim of this study is to examine the law on the issuance of checks in international trade law which was used in order to achieve the goal of the descriptive analytical method. The first time in ۱۹۱۰ the Union for international law in London regulated unified Czech rules. After that, in ۱۹۲۱, The Hague Conference invented regulations in the field of Czech legal unity. This favorable path that was leading towards the regulation of a multilateral pact. Today, most countries around the world have signed or joined the Geneva Convention on unified law. The findings showed that in checks, the place of payment act plays a special role and is in many cases the most appropriate law. In the case of the effects of obligations, the Geneva conventions, according to the principle of independence of signatures, consider each signature to be subject to the rights of the country where the obligation occurred, which in some cases has been modified in favor of the country where the payment was made.
