چکیده مقاله:

Intellectual property rights in the era of globalization are considered one of the most important legal and economic issues. Globalization, as a phenomenon that breaks down geographical borders and facilitates the free exchange of goods, services, and ideas, has created new challenges and opportunities for intellectual property rights. In this era, inventions, innovations, and artistic works can easily be transferred from one country to another. This rapid and widespread transfer of information and ideas can contribute to the economic and cultural growth of countries; however, it also poses serious threats to intellectual property rights. For instance, copying and infringement of the rights of publishers and artists have become a global dilemma. Developing countries, due to the lack of adequate legal and regulatory infrastructure, are more vulnerable to these threats, which can lead to a decrease in innovation and creativity incentives in those nations. In response to these challenges, international communities have sought to establish global standards for intellectual property rights through various agreements and conventions. One of the most important of these agreements is the TRIPS Agreement, which was adopted by the World Trade Organization (WTO) and obligates member countries to adhere to minimum intellectual property standards. This convention can particularly serve as a tool for attracting foreign investments and promoting new technologies in developing countries. However, the proper and fair enforcement of these rights globally remains challenging. Different countries with diverse cultures and legal systems may encounter disputes in interpreting and implementing these rights. Furthermore, it is important to ensure that the protection of intellectual property rights does not hinder public access to essential knowledge and technologies. Therefore, in the era of globalization, there is a need for a balanced and coordinated approach to manage intellectual property rights in a way that simultaneously addresses the interests of innovators and the public good.
