چکیده مقاله:
One of the criticisms of the law 'supporting the family and the youth of the population' is about its potential to violate the rights of children who are born under the influence of its incentive plans. Among these rights, children's right to happiness is one of the examples of human rights and citizenship rights. In view of the necessity of matching the country's laws with the foundations and rules of Islam and considering the jurisprudential rules regarding the discussion of happiness and the restrictions that have been raised regarding some of its types in Islamic jurisprudence, in this matter as in similar cases, the principle of Islamic and jurisprudential foundations and laws is violated. In this article, in order to respond to the aforementioned criticism and suspicion of the possibility of infringing the right of children, by descriptive-analytical method, the order of happiness in Islam and the teachings of the Prophet (PBUH) as the first designator of jurisprudence and Islamic thought are discussed in order to explain the position of children's right to happiness in his eyes, in order to make a comparison between the perspective and approach of the Prophet of Islam (PBUH) and the perspective of the observers of the Convention on the Rights of the Child, which is the main document of the critics. The result of the research is that the children's right to happiness cannot be truly realized by implementing the provisions of the convention, and considering the wealth of Islamic sources, efforts should be made to prepare a comprehensive document for the protection of children's rights, which is one of the effects of realizing the right to happiness of future children.
