A comparative study of intellectual property rights related to artificial intelligence in Iran and Germany: challenges and opportunities

This article examines and compares the intellectual property rights system related to artificial intelligence (AI) in Iran and Germany. Given the rapid development of AI technology and its role in creating innovative works, the need to clarify legal frameworks to protect the intellectual property (IP) of these works is increasingly evident. In this study, the existing laws in Iran (such as the Patent, Industrial Designs, and Trademarks Registration Law of ۲۰۰۷ and the Authors, Composers, and Artists Rights Protection Law of ۱۹۶۹) and Germany (such as the Patent Act of ۲۰۲۰ and the Copyright Act of ۲۰۲۱) are analyzed and the differences and similarities are examined. The results show that Germany, as a member of the European Union, has more advanced and harmonized frameworks, while Iran faces challenges such as legal gaps, lack of alignment with international standards, and inadequate infrastructure. Country-specific challenges are highlighted, such as the ambiguity of ownership of AI works in Iran and the complexity of EU laws in Germany. Opportunities, such as Iran leveraging Germany’s experience to update its laws and Germany’s potential to lead in setting global AI related IP standards, are also explored. Finally, suggestions are made for improving Iran’s intellectual property system, including developing specific laws for AI and joining international treaties.
