Investigation of Phishing Cybercrime: Challenges and Opportunities

Artificial intelligence is one of the new sciences that has been around for half a century and has been able to have an undeniable impact on most areas of human life by proving its capabilities and efficiency. If in the past, the recourse of judicial institutions to artificial intelligence to manage crime was far from the mind and was considered an ideal, but today the movement of automating criminal justice is an undeniable reality. An algorithm that is able to predict human behavior and measure its dangerous level can be used by judicial authorities, not only to prevent recidivism, but also to help choose the appropriate punishment or make a decision to grant conditional release. In this way, the criminal justice system will move on the track of prediction more than in the past. Therefore, the present article will examine the legal consequences of the cybercrime of phishing in the legal system of the Islamic Republic of Iran, the challenges and opportunities arising from it will be examined, and it will provide possible solutions to deal with the actual and potential threats caused by the crime of phishing.
