چکیده مقاله:
Today, artificial intelligence, as a new technology, is able to create improvements and loopholes in the process of judicial proceedings. Artificial intelligence may create challenges in the field of maintaining civil rights and privacy, transparency and justice, providing uncertain information and data, and lead to a decrease in the interaction between humans and the court. This research can help to improve our understanding of this technology and how it is used in courts, and it can also help to evaluate the positive and negative effects of artificial intelligence on judicial proceedings and its effect on justice and access to proceedings. Artificial intelligence is one of the branches of computer science that was invented in the middle of the ۲۰th century. This technology was supposed to allow computers to think independently and intelligently and automatically. The original idea of artificial intelligence belonged to Alan Turing, who believed that if humans can think logically and make decisions, why can't machines? His philosophy developed over time, and decades later led to the creation of algorithms that could logically search terms. Later, with the development of the concept of big data, neural networks and deep learning algorithms, artificial intelligence also evolved a lot and entered many fields. In the last decade, this technology has been widely used for tasks such as automatic face and object recognition, medical imaging or financial analysis. Today, however, artificial intelligence has entered everyday life and anyone can use it for professional work or entertainment. Naturally, the judicial system will soon be affected by this technology. Judiciary is one of the powerful foundations of the fight against corruption and discrimination in society. The process of justice in society should be shortened by benefiting from modern accountability systems in the judiciary. Necessary training to the community to inform people about how to defend their rights should be on the agenda of the judicial system. Information technology on judicial proceedings is a new concept that has emerged in the last few decades and is very important. In general, information technology on judicial proceedings is to conduct the judicial process using new electronic and communication methods. Therefore, in the present article, the effects of the judiciary's use of new technologies and artificial intelligence have been investigated in a theoretical, descriptive and analytical way. The findings and results of the research indicate that by compiling relevant laws and creating technical infrastructure, communication systems and computer software have been designed and implemented by the judiciary. Among the most important of these systems are judicial case management systems, electronic notification, judicial service offices, self-users of lawyers and experts. In general, social behavior as a subject of legal science is one of the most important topics affected by the emergence of new technologies. In recent years, new legal technologies have tried to increase public access to justice.
