This review article examines the complex philosophy of prison punishment as expressed in Islamic jurisprudence and its juxtaposition with contemporary legal frameworks. This article seeks to address the philosophical underpinnings of imprisonment as presented both in Islamic jurisprudence and in contemporary legal frameworks. By examining the background and theoretical foundations, this research aims to reveal the nuances and differences of views surrounding the purpose, justification and consequences of imprisonment. The purpose of this analysis is to critically evaluate how these principles inform current criminal practices and identify potential areas of convergence and divergence with modern legal systems. Through a comprehensive review of relevant literature and case studies, the results reveal a complex interplay between traditional Islamic punitive measures and contemporary rehabilitation approaches. Ultimately, this study underscores the need for a nuanced understanding of punishment that reconciles religious principles with evolving social norms and supports a framework that enriches both Islamic jurisprudence and modern legal thought.
