چکیده مقاله:
Legitimate defense (self-defense) is a major issue in international law, meaning the inherent right of individual or collective defense in the case of an armed attack on a country until the Security Council takes the necessary actions to restore and maintain international peace and security. Self-defense is recognized as a legal rule, as well as, a general legal principle accepted by all legal systems in the world. Self-defense has been always one of the most important and controversial issues in international law. The cases involving self-defense in international law that are approved by Islamic jurisprudence based on religious standards include ۱) the occurrence of an armed attack, ۲) the defense of territorial integrity and political independence, ۳) the protection of nationals, and ۴) the defense of legal rights and vital interests. Israel’s military attack on the Iranian consulate has been a violation of Syria’s national sovereignty and aggression against Iran; therefore, it can be stated that the primary element of the right of self-defense against aggression and violation of sovereignty has been realized according to Article ۵۱ of the United Nations (UN) Charter, which has necessitated self-defense for our country.
