چکیده مقاله:
Background and Aim: Despite the scientific advances in the field of dentistry, unfortunately, the trend of complaints from dentists is increasing. Several reasons have been investigated for this phenomenon, the increase in population, the increase in the number of dentists, the increase in community awareness and the use of lawyers and legal advisors can be mentioned as important reasons. In this article, we want to examine ways to prevent dental malpractice (errors).Method: This research has been compiled using library sources and descriptive analytical research methodEthical Considerations: The present research has been written with respect to ethical principles trustworthiness and honesty.Results: As a result, several centers, are responsible for handling patients' complaints about dentists. Islamic Penal Code, Criminal Procedure Law, Medical System Organization Law, and the Code of Conduct for Professional and Trade Union Violations of Dentists are the legal foundations of these proceedings. The punishments mainly include disciplinary punishments or payment of ransom.Conclusion: Development of technical standards for different types of dental services, Determining the maximum retirement age, rationalizing treatment tariffs, monitoring the quality of dental services, increasing the awareness of dentists about malpractice and medical violations and how to deal with it, Specializing medical criminal courts, amending the Islamic Penal Code, benefiting from the advice of forensic experts and using professional liability insurance coverage can help to effectively improve the situation governing the handling of professional malpractice. Increasing awareness of the current laws on private practices can play an important role in planning the relationship between dentists and their patients based on legal rules and regulations and also be effective in preventing medical malpractice.
