چکیده مقاله:
Background and purpose: Due to the spread of the corona pandemic, which led to the infection of many people in the society; Based on this, governments tried to fight this disease and take measures to prevent it; On the other hand, among the cases that can contribute to the increase of the epidemic are some crimes against judicial justice, including the concealment of testimony. Therefore, the purpose of this article is to investigate the jurisprudence of the concealment of testimony in the outbreak of epidemic diseases (a case study of the Corona pandemic).Method: This research is of a theoretical type and the research method is descriptive-analytical, and the method of collecting information is library-based, referring to documents, books and articles.Ethical considerations: In all stages of writing the present research, while respecting the originality of the texts, honesty and trustworthiness have been observed.Findings: The findings of the research indicate that during the outbreak of the epidemic, the concealment of testimony is prohibited based on jurisprudential rules, including the prohibition of concealing the truth, the rule of pride, the rule of caution, and the rule of harm, causing the spread of the epidemic and causing a lot of loss of life and money to real and legal persons in the corner. And it will bring the world together.Conclusion: Legal texts are not needed to realize the crime against judicial justice, but to determine the examples of error and fault, it is enough that the act or omission of the act leads to damage to another person and this damage appears unusual in the eyes of custom; Whether the said act or omission is prohibited by law; Whether it is not due to the prohibition of the law, as a result of the concealment of testimony, which, despite not being prohibited by law, is prohibited based on jurisprudence, and this matter is important in critical cases such as disease epidemics, and therefore requires the attention of the legislator to criminalize it.
