چکیده مقاله:

International human rights law guarantees everyone the right to the highest standard of health and obligates governments to take all measures necessary to prevent threats to public health and provide medical care to those in need. The human rights law also emphasizes that in the conditions of serious threats to public health and public emergencies that threaten the lives of the nation, restrictions on some rights can be justified if they have a legal basis. These absolutely necessary measures should be based on scientific evidence (and not arbitrary) without any discriminatory aspects, limited in duration, with respect for human dignity, subject to review, and proportionally designed and implemented. On March ۱۱, ۲۰۲۰, the World Health Organization (WHO) announced that the outbreak of the viral disease COVID-۱۹ - first identified in December ۲۰۱۹ in Wuhan, China - has reached the level of a global pandemic. Citing concerns about "alarming levels of prevalence and severity," the WHO, therefore, called on governments to take immediate and aggressive measures to prevent the spread of the virus. The scale and severity of the Covid-۱۹ pandemic are clearly rising to the level of a public health threat that can justify restrictions on certain rights, such as those resulting from the imposition of quarantine and restrictions on freedom of movement. At the same time, careful attention to human rights such as non-discrimination and principles of human rights such as transparency and respect for human dignity can create an effective response, and harm limits what it can create. This research is a review of the performance of the World Health Organization regarding human rights concerns and emphasizing "the Right to Healthcare".
