Reasons for Lack of Retribution Punishment for Apotropos (LegalGuardian) in Islamic Penal Code and Iranian Judicial Precedent

Filicide is a tragedy that most communities have experienced. It is a heinous andunaccepted act. This tragedy, however, is an ordinary and acceptable act for thepreparator based on the conditions and reasons for the murder. Regardless of the slain'sidentity, murder is a great crime with heavy punishment. Murder of a man whose killingmust be prevented (Mahghoon-Aldam) is a crime against self and carries the retributionpunishment. However, the retribution is executed under some circumstances based onArticle ۳۰۱ of the Islamic Penal Code. Hence, this ancient punishment is enforced ifthere is no fathership (or paternal grandfather) between murderer and victim
