With the emergen ce of any new technolo gy, nanotechnology cre ates opportunities as well as challenges in ada pting the patent regime to its particular contex t. There is some consensus that patenting nanotechnology innovations poses more problem s than other techn ologies, owing to their multi-disci plinary character, cross-sectoral applications, broad claim s as well as difficulties in fulfilling the patenta bility criteria. This is aggravated b y the lack o f a standardized termi nology whi ch impedes easy identification of nano-patents and also t he fact that patent offices may not be well-equipped to handle nanotechnology. These proble ms are likely to be co mpounded for developi ng and least developed countries, which irresp ective of t heir state of technolog ical advancement, an d capacity of the dom estic regime, are oblige d to confer IPR in the n ew technology.In order to keep a desired leve l of in dept h analysis this work will only conte mplate the TRIPS Agreement. The p aper finally arrives at certain rec ommendations, to help reconcil e the need to incentiv ize innovation in the new techn ology, with the imper ative of ensuring that th e public interest is served and access to the patented knowledge is not hindered.
