Unauthorized Change of Use or the Emergencies of Modern Life (Analysis of the Laws Approved for Agricultural Lands and Gardens)

The urgency of modern life and the desire to live in environments outside the urban and rural context, which is known as a better system in global societies, in our country, due to the lack of a suitable platform for the implementation of people who are interested in living in such environments, has caused us to witness disorder in our agricultural lands and gardens and a threat to the face of gardens and agriculture with high-quality soil. The change in use of these lands is intertwined with the opposite concept of villa and luxury life, which can be clearly seen on the outskirts and boundaries of cities; also, due to the conflicts of relevant laws and the lack of positive and negative effects of existing regulations, it has caused the sustainable development of agriculture, food security and water resources of the country to face serious risks. The type of use in agricultural lands and gardens with the location of different areas in urban and suburban areas, the privacy of Article 17 of the Road and Railway Safety Law, the privacy of rural areas, national and agricultural areas in the way of changing use and also protecting it are among the issues that have created confrontations and conflicts with the multiplicity of laws; It is true that the legislator has considered changing use in agricultural lands and gardens to be unauthorized and a criminal act and has enacted regulations in this regard to protect the use of agricultural lands and gardens; But as mentioned, its effects are not acceptable and need to be amended. This article examines the different dimensions of changing use in agricultural lands and gardens in the urban and suburban suburbs, examining the concept of rural life opposing modern life, and also the legal status of changing use in these lands.
