چکیده

The issue of "custody" is one of the complex issues in thefield of family law. When a family is disrupted for any reason, such asdivorce or the death of one or both parents, the issue of child custodybecomes one of the main challenges facing the family. This issue hasvarious aspects that require careful investigation and despite theefforts of jurists and various opinions that have been presented, thereare still uncertainties. Therefore, the research was conducted with theaim of examining the issue of custody of children in the case offemale heads of the household and provides solutions with anemphasis on jurisprudence and legal principles. The research has beendone using the descriptive-analytical method and collectinginformation from specialized jurisprudential and legal sources andIslamic science software. By analyzing the issues mentioned in thisresearch, we come to the conclusion that custody is an issue that isclear and clear since the birth of the child and is often discussed afterthe separation of couples. Regarding the duration of custody,jurisprudential commentators believe that the mother is more suitablefor custody of the child up to two years (or up to seven years if it is agirl), but the legislator has not made a difference in the priority of thecustody of the mother until the children are seven years old. Finally, itshould be noted that the right of custody in Iranian law is mostlygiven to the mother, but the father also has rights and duties in thisfield. The mother generally has the right to choose whether to acceptor reject custody, except in special circumstances in which it willassume the color of responsibility. If custody is entrusted to themother, she is obliged to follow Shari'a, legal and customarystandards and follow the specific limits of the situation.
