چکیده مقاله:

The intellectual property right of an artwork is the license to creativity and development of artistic careers. Artists working with environmental elements or recycled objects as media are not an exception. The Intellectual property rights which are supposed to legally support the artists and their work seem to fail in the field of environmental or recycled art, as the artwork as a physical object with the same characteristics of the artworks inside the museum is not present here. The art pieces in the named field are too huge to be executed or created inside the cities, thus they are transferred to the open fields and locations outside the urban areas, jungles, deserts, rivers, etc. Since the only method of being legally supported for artwork is to be submitted in the Copyright offices of a country, in works executed in environmental fields and inside the nature or huge art pieces with recycling or junk objects, the cases of legal submission are often neglected. The hypothesis of the present study therefore is: Since the environmental artists and those working with recycling objects in recycled art try to inform the world about the limited natural resources and the importance of preserving them for the next generations, are not taken seriously as artists creating pure art, but as activists dealing with slogans, information, and cultural development etc. in the field of sustainable development, and thus the legal process of submitting the pieces are often neglected. The aim of this article is to study the legal aspect of environmental and recycled art in the field of intellectual property rights in the world, in order to conclude that legally supporting artworks with informative content would encourage the artists to create more responsibly and this would be more encouraging for the environmental preserving targets. This descriptive-analytical study has gained library documents and compared the cases in different countries.
